Terms and Conditions
These Terms and Conditions govern the use of the ChartNav service (the "Service"). By accessing or using the Service, the User acknowledges having read and accepted these Terms in full. The Owner of the Service is ChartNav ("Owner", "we", "us"). Contact: legal@chartnav.ai.
What the User should know at a glance
- The Service is provided free of charge and is currently in public beta. Features may change, be suspended, or be discontinued at any time.
- All data displayed on the Service — including AIS positions, weather, tides, currents, and chart information — is provided for informational purposes only and may contain errors, omissions, or delays.
- No account registration or payment is required to use the core Service.
- European, United Kingdom, and certain US-state consumers have specific rights described in the sections below and in the Privacy Policy.
Terms of Use
Scope
The following usage conditions apply to all Users of the Service. By using the Service, Users confirm that they meet the following requirements: there are no restrictions on Users being Consumers or Business Users; Users are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist-supporting" country; Users are not listed on any U.S. Government list of prohibited or restricted parties.
Account registration
The Service does not currently require account registration. If account functionality is introduced in the future, Users will be required to provide truthful information and will be responsible for maintaining the confidentiality of their credentials and for all activities occurring under their account. Users must immediately inform the Owner of any suspected unauthorized use of their account. Additional terms governing accounts will apply when such functionality is introduced.
Content on the Service
Unless otherwise specified, the branding, user interface, source code, graphics, layouts, and original documentation of the Service are the property of the Owner and are protected by applicable intellectual property laws. Users may not reproduce, modify, translate, publish, distribute, or create derivative works from such content except as expressly permitted by these Terms or by applicable law. Map tiles, chart data, vessel imagery, and other third-party content are provided under their respective licenses — see the Acknowledgements page for attributions.
AIS data itself consists of publicly broadcast radio signals and is not claimed as proprietary by the Owner. Attribution to the Owner is appreciated when sharing visual output from the Service.
Access to external resources
Through the Service, Users may have access to external resources provided by third parties. Users acknowledge and accept that the Owner has no control over such resources and is therefore not responsible for their content or availability. Conditions applicable to any resources provided by third parties, including those applicable to any possible grant of rights in content, result from each such third party's terms and conditions or, in the absence of those, applicable statutory law.
Acceptable use
The Service and the content must be used only for the purposes for which they are offered, under these Terms and under applicable law. Users are solely responsible for making sure that their use of the Service does not violate any applicable law, regulation, or third-party right. Without limitation, Users agree not to:
- use the Service to facilitate any unlawful activity, including smuggling, piracy, unauthorized surveillance, or sanctions evasion;
- use the Service in any manner that could impair maritime safety or interfere with search-and-rescue operations;
- systematically scrape, harvest, or extract data from the Service through automated means without prior written consent;
- redistribute, resell, or commercially exploit data obtained from the Service without authorization;
- attempt to interfere with, disrupt, probe, or gain unauthorized access to the Service, its infrastructure, or other Users' sessions;
- use the Service in a way that may cause excessive load on backend data providers (NOAA, NDBC, NWS, and similar);
- impersonate any vessel, person, or entity, or misrepresent an affiliation with the Owner;
- remove, obscure, or alter any copyright, trademark, or attribution notice.
The Owner reserves the right to deny access to the Service, temporarily or permanently, to Users who are found to be in violation of the above, without notice and without prejudice to any other rights or remedies.
Software license
Subject to the User's compliance with these Terms, the Owner grants the User a revocable, non-exclusive, non-sublicensable, and non-transferable license to use the client-side software delivered by the Service (including JavaScript, stylesheets, and associated assets) solely for the purpose of accessing and using the Service through a standard web browser or installed progressive web application. All rights not expressly granted are reserved. Use of the software is also governed by the End-User License Agreement.
API and data usage
Where the Owner exposes programmatic endpoints, their use is subject to these Terms and any additional rate-limit, authentication, or usage rules communicated by the Owner. The Owner may modify, restrict, or discontinue any such endpoint at any time. Any use of such endpoints is at the User's own risk, and the Owner disclaims liability for losses arising from changes to or unavailability of those endpoints.
Data accuracy and informational nature of the Service
The data presented through the Service is derived from AIS radio transmissions, publicly available governmental and meteorological data sources, and third-party providers. The Service is an aid for informational, situational-awareness, and research purposes only. The nature of AIS means that information may be delayed, incomplete, spoofed, or contain errors introduced at the source; vessel operators are responsible for the accuracy of their own AIS transmissions, including static data such as vessel name, dimensions, destination, and type. Weather, tide, current, and radar information carries inherent uncertainty and may be delayed relative to real-world conditions. Users must not rely solely on the Service for navigation, safety, or compliance decisions.
Liability and indemnification
Disclaimer of warranties
The Service is provided strictly on an "as is" and "as available" basis. Use of the Service is at Users' sole risk. To the maximum extent permitted by applicable law, the Owner expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing, usage, or trade. Without limiting the foregoing, the Owner does not warrant that the Service will be uninterrupted, timely, secure, accurate, complete, or error-free; that defects will be corrected; that the Service is free of viruses or other harmful components; or that the results obtained from the Service will be accurate or reliable.
Limitation of liability
To the maximum extent permitted by applicable law, in no event shall the Owner, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to personal injury, property damage, loss of profits, loss of data, cost of substitute goods or services, or any other intangible losses arising out of or in connection with the Service, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not the Owner has been informed of the possibility of such damage. To the extent that applicable law does not allow the exclusion or limitation of certain damages, the Owner's aggregate liability shall be limited to the greatest extent permitted by such law.
Australian Users — limitation of liability
Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy which the User may have under the Competition and Consumer Act 2010 (Cth) or any similar State and Territory legislation and which cannot be excluded, restricted or modified (non-excludable right). To the fullest extent permitted by law, the Owner's liability to the User, including liability for a breach of a non-excludable right, is limited, at the Owner's option, to the re-supply of the Service or the payment of the cost of having the Service supplied again.
United States Users — disclaimer and limitation
The Service is provided strictly on an "as is" and "as available" basis and the Owner expressly disclaims all representations and warranties of any kind. The Owner shall not be liable to any User for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, personal injury, or property damage, whether foreseeable or not.
Indemnification
The User agrees to defend, indemnify and hold the Owner and its subsidiaries, affiliates, officers, directors, agents, co-branders, partners and employees harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses, including, but not limited to, legal fees and expenses, arising from: (a) the User's use of and access to the Service, including any data or content transmitted or received by the User; (b) the User's violation of these Terms; (c) the User's violation of any third-party right, including without limitation any right of privacy or intellectual property rights; (d) the User's violation of any statutory law, rule, or regulation; or (e) any claim that content submitted by the User caused damage to a third party.
Common provisions
No waiver
The Owner's failure to assert any right or provision under these Terms shall not constitute a waiver of any such right or provision. No waiver shall be considered a further or continuing waiver of such term or any other term.
Service interruption
To ensure the best possible service level, the Owner reserves the right to interrupt the Service for maintenance, system updates, or any other changes, informing the Users appropriately where possible. Within the limits of law, the Owner may also decide to suspend or discontinue the Service altogether. If the Service is discontinued, the Owner will cooperate with Users to enable them to remove Personal Data or information residing on their devices (such as locally stored fleet and route data) in accordance with applicable law.
Service reselling
Users may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service or access to the Service without the Owner's express prior written permission, granted either directly or through a legitimate reselling program.
Privacy policy
To learn more about the use of their Personal Data, Users may refer to the Privacy Policy of the Service.
Intellectual property rights
Without prejudice to any more specific provision of these Terms, any intellectual property rights, such as copyrights, trademark rights, patent rights, and design rights related to the Service are the exclusive property of the Owner or its licensors and are subject to the protection granted by applicable laws or international treaties relating to intellectual property. All trademarks — nominal or figurative — and all other marks, trade names, service marks, word marks, illustrations, images, or logos appearing in connection with the Service are, and remain, the exclusive property of the Owner or its licensors and are subject to the protection granted by applicable laws or international treaties related to intellectual property.
Changes to these Terms
The Owner reserves the right to amend or otherwise modify these Terms at any time. In such cases, the Owner will appropriately inform the User of these changes. Such changes will only affect the relationship with the User from the date communicated to Users onwards. The continued use of the Service will signify the User's acceptance of the revised Terms. If Users do not wish to be bound by the changes, they must stop using the Service.
Assignment of contract
The Owner reserves the right to transfer, assign, dispose of by novation, or subcontract any or all rights or obligations under these Terms, taking the User's legitimate interests into account. Users may not assign or transfer their rights or obligations under these Terms in any way without the written permission of the Owner.

Severability
Should any provision of these Terms be deemed or become invalid or unenforceable under applicable law, the invalidity or unenforceability of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
Governing law
These Terms are governed by the laws of the place where the Owner is based, without regard to conflict of laws principles. Notwithstanding the foregoing, if the User qualifies as a "Consumer" and has their habitual residence in a jurisdiction whose law provides a higher standard of protection, such higher standard shall prevail.
Venue of jurisdiction
The exclusive competence to decide on any controversy resulting from or connected to these Terms lies with the courts of the place where the Owner is based, except as otherwise provided by mandatory consumer-protection law.
Dispute resolution
Users are encouraged to communicate any dispute relating to these Terms or the Service to the Owner, which will try to resolve it amicably. Should an amicable solution not be reached within a reasonable timeframe, the dispute may be brought before the courts indicated above, subject to any mandatory consumer-protection law applicable to the User.

ChartNav (or this Service)
The property that enables the provision of the Service, as described in these Terms.
Owner (or We)
Indicates the natural person(s) or legal entity that provides the Service to Users.
User (or You)
Any natural person or legal entity using the Service.
Consumer
Any User qualifying as such under applicable law.
Terms
These provisions applicable to the use of the Service, as also referred to in any other related document or agreement, and as updated from time to time.
